1. scope of application

For all orders through our online store by consumers and entrepreneurs, the following terms and conditions apply.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

The following shall apply to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.

The purchase contract is concluded with The Other Walk GmbH.

By placing the products in the online store, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

The language available for the conclusion of the contract is German.

We store the contract text and send you the order data and our terms and conditions in text form. You can view your order in our customer login.

4. delivery and sales conditions

After the order confirmation, we will send you the ordered items to the delivery address you specified in the form of a nice package. The usual delivery time is 2-3 working days.

If the delivery of the goods fails despite several delivery attempts, TheOtherWalk can withdraw from the contract.

5. offer

Our online offer is subject to change and non-binding. As a rule, the items offered in the online store are available. If it is not possible to deliver one or more articles due to a stock discrepancy, Stadtlandkind will inform you about this circumstance as soon as possible and offer you equivalent articles. If none of these articles suits you, the amount will be refunded.

Our sales prices are ex stock and are quoted in Swiss Francs excluding shipping costs. Delivery and shipping

We deliver within the whole of Switzerland and the Principality of Liechtenstein.

For our delivery within the whole of Switzerland and the Principality of Liechtenstein you pay a delivery charge of CHF 7.90. For pure voucher orders there are no delivery charges".

8. payment options

In our store, the following payment methods are generally available:

8.1 Invoice

You pay within 14 days after receipt of the goods by bank transfer. For the first purchase on account, we check their creditworthiness for our protection. For the protection of the credit risk we ask for your understanding that we have to reserve the right to demand an advance payment in case of corresponding creditworthiness. In these cases, we will contact you before concluding the contract.

8.2 Credit card, Paypal

You can also pay for your order by TWINT, PayPal or by credit card (VISA, Mastercard) via the secure payment system "stripe". The fees of the card institutions are borne by "The Other Walk".

8.3 Default of payment

In case of late payment, we are entitled to charge you a fee of CHF 10.00 from the 3rd reminder. Reminders and invoices will be sent by e-mail. In the event of late payment, The Other Walk is also entitled to assign the claim and cost consequence for the debtor to third parties. The assertion of further damages remains reserved.

9. right of withdrawal

Consumers are entitled to the statutory right of withdrawal, as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

For consumers, the following applies: If goods are delivered with obvious transport damage, please complain about such defects as soon as possible to the delivery company and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

9 Warranty and guarantees

Unless otherwise expressly agreed below, the statutory liability for defects shall apply. The Other Walk GmbH expressly reserves the right to provide the purchaser with a replacement free of defects in the event of asserted and established defects in the purchased item. 

The above restrictions and shortening of time limits do not apply to claims based on damages caused by us, our legal representatives or vicarious agents

- in case of injury to life, body or health

- in case of intentional or grossly negligent breach of duty as well as fraudulent intent

- in the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and compliance with which the contractual partner may regularly rely on (cardinal obligations)

- within the scope of a guarantee promise, if agreed upon

- insofar as the scope of application of the Product Liability Act is opened.

10. gift certificate

Gift certificates are vouchers that you can purchase. You can pay for your order with a gift certificate from The Other Walk. To do so, enter the code on the gift certificate in the appropriate field on the order. A gift certificate can only be redeemed before the order process is completed and for the full amount.

The amount of the voucher is predefined. The vouchers are issued exclusively in CHF and are freely transferable.

A cash payment is excluded.

11 Promotion Vouchers

Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of promotional campaigns. Promotion vouchers are redeemable only under the conditions mentioned therein, by the respective recipient, in the specified period and only once per person. Individual products may be excluded from voucher promotions.

Promotion vouchers can be redeemed for a minimum order value of CHF 20; the value of the goods must in any case be at least equal to the amount of the promotion voucher. Any difference to a higher value of goods must be settled with the payment options offered. Promotion vouchers are neither paid out in cash nor do they bear interest.

A refund or re-delivery of promotion vouchers in case of partial or total return of the ordered products is excluded. Promotion vouchers can only be redeemed before the order process is completed. A subsequent crediting is not possible. The promotional voucher is not transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher when making your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below the value of the promotional voucher.

15 Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation

- in case of injury to life, body or health

- in case of intentional or grossly negligent breach of duty

- in the case of warranty promises, insofar as agreed, or

- insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and the observance of which the contractual partner may regularly rely on (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

16 Right of return

You can cancel the contract within 14 days after receipt of the goods with a description of the reason for return by returning the goods. The return of the goods is at your responsibility and expense.

Only items that are absolutely intact and in perfect, unworn condition will be accepted for return. The articles must be returned in the original, unglued and undamaged packaging. In particular, worn, soiled, damaged or bad smelling products cannot be returned. If this is not the case, we reserve the right to claim for compensation.

The amount of a return item can be deducted from the total amount. If the total amount has already been transferred to The Other Walk, you can choose between a voucher or a cash refund. Shipping charges will not be refunded.

18. place of jurisdiction

Swiss law is applicable. The place of jurisdiction is the registered office of The Other Walk GmbH in Bühler.

19. final provisions

Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant legal provisions shall apply.
